Duties and Responsibilities
The Circuit Clerk’s office is responsible for filing criminal and civil cases in the Circuit Court of Clay County, as well as appeals from lower court and administrative agencies. We receive and file lawsuits, indictments, motions, bonds, issue subpoenas, summon jurors, collect fines and record orders. Other duties include recording judgments, issuing and recording marriage licenses, voter registration, absentee voting and other duties.
Circuit Court
The Clay County Circuit Court is in the Sixteenth Circuit Court District. Circuit Court Terms are in January, April, July and October. Grand Jury terms are during the April and October Terms. Also see the Upcoming Events for court terms and Court System for Judges information.
Jury Service
- Qualifications: Resident of Clay County, at least 21 years old, able to read and write, and not have been convicted of a felony
- Excuses: Over the age of 65, personal hardship, served on jury duty in this court in last two (2) years
- Rate of pay: $25 per day and .40 per mile if you live outside the city limits
- Checks will be mailed out after court

Election Info
One of the duties of the Circuit Clerk’s office is the county registrar. You can register to vote at the Circuit Clerk's office, the Department of Human Services office, at one of the High Schools, or when you renew your driver's license. You can also register by printing off a voter application and mailing it to the Circuit Clerk's office. The registration deadline is 30 days prior to an election. The Circuit Clerk's office also handles absentee voting, and assisting the Election Commissioners with purging and preparation of the election.

- Applicants must apply at least 3 days before marriage
- Applicants must have their results of Blood Work
- Copy of Valid ID with proof of age
- Fee of $22 Cash only
- Records date back to May 18, 1872 (Colfax County)

- Sheriff’s Fee $35.00 each
- Abstract of Judgment $5.00

- Certified copy of Marriage License $10.00
